First Hawaii DUI: 

  • Imprisonment: 48 hours - 5 days. Additional 48 hours if child under 15 in vehicle.
  • Fines: $150 - $1,000. Additional $500 if child under 15 in vehicle.
  • Driver's License Suspension: 30 day prompt suspension (Driving Limited to Court Approval), or 90 days prompt suspension (May be Allowed to Drive), BAC above .15: 6 month suspension (Absolute Prohibition on Driving)
  • Community Service: 72 hours
  • Court Ordered Substance Abuse and Education Program: 14 hours required
  • Ignition Interlock Device: Administrative Driver's License Revocation Office (ADLRO) will require installation of IID for 1 year. 

Second Hawaii DUI: 

  • Imprisonment: 5 to 14 days. Additional 48 hours if child under 15 in vehicle.
  • Fines: $500 - $1,500. Additional $500 if child under 15 in vehicle.
  • Driver's License Suspension: 1 - 5 years
  • Community Service: 240 hours minimum
  • Court Ordered Substance Abuse and Education Program: Required
  • Ignition Interlock Device: Required during period of revocation

Third Hawaii DUI:

  • Imprisonment: 10 to 30 days. Additional 48 hours if child under 15 in vehicle.
  • Fines: $500 - $2,500. Additional $500 if child under 15 in vehicle.
  • Driver's License Suspension: 1 - 5 years
  • Community Service: 240 hours minimum
  • Court Ordered Substance Abuse and Education Program: Required
  • Ignition Interlock Device: Required during period of revocation
