Illinois DUI Penalties | Consequences of Drunk Driving in Illinois : Jail Time, Fines, License Suspension

 

First Illinois DUI (Class A Misdemeanor):

  • Imprisonment: Up to 1 year
  • Fines: Up to $2,500
  • Driver's License Suspension: Minimum 1 year. Eligible for Monitoring Device Driving Permit (MDDP) on 31st day of suspension. 
  • Ignition Interlock Device: Required
  • Vehicle Registation: May be suspended

First Illinois DUI with BAC .16 or Greater:

  • In addition to the first DUI penalties listed above, a First Offense DUI With BAC .16 or Greater in Illinois requires:
    • Mandatory minimum $500 fine, and
    • Mandatory minimum 100 hours community service

First Illinois DUI While Transporting a Child Under Age 16:

  • In addition to the first DUI penalties listed above, a First Offense DUI While Transporting a Child Under Age 16 requires:
    • Possible imprisonment up to 6 months; 
    • Mandatory minimum $1,000 fine; and
    • 25 days community service in a program benefitting children

Second Illinois DUI (Class A Misdemeanor):

  • Imprisonment: Mandatory minimum imprisonment of 5 days or 240 hours of community service. 
  • Fines: Up to $2,500
  • Driver's License Suspension: Minimum 5 years. 
  • Ignition Interlock Device: Required if defendant is able to obtain a Restricted Driving Permit (RDP). 
  • Alcohol Education Awareness Program: Required

Second Illinois DUI with BAC .16 or Greater:

  • In addition to the second DUI penalties listed above, a Second Offense DUI With BAC .16 or Greater requires:
    • Mandatory 2 days imprisonment; and
    • $1,250 fine.

Third Illinois DUI (Aggravated DUI - Class 2 Felony):

  • Imprisonment: 3-7 years. If committed with BAC .16 or greater: Mandatory 90 days imprisonment
  • Fines: up to $25,000. If committed with BAC .16 or greater: Mandatory minimum fine of $2,500.
  • Driver's License Revocation: minimum 10 years
  • Vehicle Registration: Suspended for duration of driver's license revocation

Fourth Illinois DUI (Aggravated DUI - Class 2 Felony):

  • Imprisonment: 3-7 years.
  • Fines: up to $25,000. If committed with BAC .16 or greater: Mandatory minimum fine of $5,000. If committed while transporting a child under 16: Mandatory $25,000 fine.
  • Driver's License Revocation: Lifetime revocation of driving privileges with no relief available. 
  • Community Service (If Fourth DUI committed while transporting a child under 16): 25 days in community service program benefitting children.
