  • 1st Degree Misdemeanor
  • Imprisonment: 6 days in jail or 3 days in jail and 3 days in driver intervention program. Maximum 6 months
  • Fine: $375 - $1,075
  • Driver's License Suspension: 6 months - 3 years. Driving privileges not available for first 15 days
  • Treatment: Possibly required
  • Yellow DUI License Plate: Mandatory
  • Ignition Interlock Device: Optional

 

Second Ohio DUI within 6 Years: 

  • 1st Degree Misdemeanor
  • Imprisonment: 10 days in jail or 5 days in jail and 18 days of electronically monitored house arrest and/or Continuous Alcohol Monitoring. Maximum 6 months
  • Fine: $525 - $1,625
  • Driver's License Suspension: 1 year - 5 years. Driving privileges not available for first 45 days
  • Treatment: Mandatory
  • Yellow DUI License Plate: Mandatory
  • Ignition Interlock Device: Required
  • Vehicle Immobilization: 90 days if registered to defendant

 

Second Ohio DUI with High Test or Any Prior in 20 Years and Refusal:

  • Imprisonment: 20 days in jail or 10 days in jail and 36 days of electronically monitored house arrest and/or Continuous Alcohol Monitoring. Maximum 6 months

  • Treatment: Mandatory
  • Yellow DUI License Plate: Mandatory

Third or Subsequent Ohio DUI: 

  • 4th Degree Felony
  • Imprisonment: Minimum 1 year
  • Fine: $850 - $10,500
  • Driver's License Suspension: Possible lifetime revocation
  • Treatment: Mandatory
  • Yellow DUI License Plate: Mandatory
  • Ignition Interlock Device: Required
  • Vehicle Immobilization: Vehicle forfeited to state
